CME TERMS AND CONDITIONS

The CME Terms and Conditions (“Terms”) govern Your purchase of or subscription to the MDCalc CME product. The terms and conditions located at https://www.mdcalc.com/terms are incorporated by reference as if fully set forth herein. To the extent any provision of these Terms conflict with a document incorporated by reference, the Terms shall control.

Your CME purchase may have implications for tax reporting purposes. The cost of your CME product may or may not be tax-deductible when used for professional purposes. Please consult your tax advisor. MDCalc does not provide tax advice.

PAYMENT TERMS

You authorize MDCalc Ltd. Inc. (or its affiliates) to charge your credit/debit card at the price offered to you.

IF YOUR PURCHASE IS AN AUTOMATICALLY RENEWING SUBSCRIPTION, UNLESS YOU CHANGE YOUR AUTOMATIC RENEWAL PREFERENCE BEFORE A CHARGE, YOU UNDERSTAND YOUR SUBSCRIPTION WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE SUBSCRIPTION PRICE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU. IF YOUR CREDIT/DEBIT CARD CANNOT BE CHARGED, YOUR SUBSCRIPTION WILL EXPIRE.

Subscription(s) cannot be suspended temporarily or reactivated later. You must use the subscribed CME credits within each subscription period, and no extensions are offered for any unused credits to redeem CME. You can use your current subscription credits to redeem eligible CME earned during prior periods if not already redeemed.

On request, we will refund your subscription fee within 30 days of being charged only if you redeem no more than 4 CME credits during that period. You will receive your refund in the same form of payment you used to make the purchase, and is based on the original price you paid for the item less the value of any promotion sent to you at the time of purchase, if applicable. There are no refunds for the purchase of CME credits for immediate redemption.

Neither MDCalc Ltd. Inc. nor its suppliers or licensors makes any warranty whatsoever, including without limitation, that the operation of the Services will be uninterrupted or error-free; that any defects will be corrected; that the Services, including the servers that makes it available, is free of viruses or other harmful components; or as to the accuracy, completeness, reliability, availability, suitability, quality, non-infringement, operation or result obtained from the use of any Content, product or service provided on, accessible from or distributed through the Services.

THE SERVICES, INCLUDING ALL CONTENT AND PRODUCTS, INCLUDED IN OR ACCESSIBLE FROM THE SERVICES, ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND (EXPRESS, IMPLIED AND STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF TITLE AND NONINFRINGEMENT AND THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE), ALL OF WHICH MDCALC LTD. INC. DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW. YOUR USE OF THE SERVICES AND THEIR CONTENT AND PRODUCTS IS AT YOUR SOLE RISK.

To the extent permitted under applicable law, no responsibility is assumed for any injury and/or damage to persons, animals, or property as a matter of products liability, negligence or otherwise, or from any use or operation of any ideas, instructions, methods, products, or procedures contained in the Services. Medical and health care providers should exercise their own independent clinical judgment. No suggested test or procedure should be carried out unless, in the provider's judgment, its use is justified. Because of rapid advances in the medical sciences, we recommend that the independent verification of diagnoses, indications, and drug dosages should be made. Discussions, views, and recommendations as to medical or health care procedures, methods, products, choice of drugs, and drug dosages are the responsibility of the authors and should be checked with current medical guidelines, hospital procedures, and pharmaceutical manufacturers.

MDCALC LTD. INC. DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE ACCREDITATION STATUS OF THE ACCME-ACCREDITED PROVIDER THAT ACCREDITS CONTENT FOR MDCALC LTD. INC. YOU EXPRESSLY ASSUME THE RISK AS TO ACCURACY, COMPLETENESS, AND ACCREDITATION STATUS OF THE CONTENT.

LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL MDCALC LTD. INC. OR ITS SUPPLIERS OR LICENSORS BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR SIMILAR DAMAGES, PERSONAL INJURY (INCLUDING DEATH), LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES) ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICES OR ITS CONTENT, PRODUCTS OR SERVICES, OR SHALL THE LIABILITY OF MDCALC LTD. INC. OR ITS SUPPLIERS AND LICENSORS EXCEED A SUM EQUAL TO THE FEES PAID BY YOU HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TERMINATION

You agree that we may, under certain circumstances and without prior notice, discontinue, temporarily or permanently, your subscription and/or eliminate your account, with or without notice, for any of the following reasons (which are not intended to be exclusive): (a) breaches or violations of these Terms or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) technical or security issues or problems, and/or (e) your engagement in fraudulent or illegal activities. You agree that all terminations for cause shall be made at our sole discretion, and we shall not be liable to you or any third party for any termination of your subscription and/or account.

CHANGES

We reserve the right to change, modify, add, or remove these Terms and Conditions at any time, and you agree (including by virtue of your continued use of our services) to be bound by any such changes. Unless explicitly stated otherwise, any new features or functionality (including, without limitation, video and related projects) that augment or enhance our services shall be subject to these Terms and Conditions. Please check these Terms and Conditions periodically for any modifications.

SEVERABILITY; ENTIRE AGREEMENT

If a court finds any provision of these Terms and Conditions to be unenforceable or invalid, that provision will be enforced to the fullest extent permitted by applicable law and the other Terms will remain valid and enforceable. These Terms, together with those items made a part of these Terms by reference, make up the entire agreement between MDCalc Ltd. Inc. and You relating to Your purchase of or subscription to the MDCalc CME product, and replaces any prior understandings or agreements (whether oral or written) regarding Your purchase of or subscription to the MDCalc CME product.
